A 21-year-old man has been found guilty of the attempted sexual assault of a 15-year-old girl in South Jeffco who fought off her attacker.
A jury on Feb. 20 found Xavier McDaniel guilty of three felony charges stemming from the attack last April, which left the victim hospitalized for several days.
According to court documents, the girl was home by herself in the afternoon when McDaniel, who lived in the same apartment complex near West Bowles Avenue and South Simms Street, entered the home uninvited. He then ordered the girl to take off her tank top, and when she refused, he punched her repeatedly in the face and head.
During the altercation, the girl bit McDaniel on his hand hard enough to draw blood. The girl continued to fight McDaniel as he tried to drag her into a bedroom. The girl was able to get away from McDaniel, and he fled.
The girl suffered a subdural hematoma, lacerations, bruising and a broken tooth, along with losing consciousness several times.
When she saw that McDaniel had left her apartment, the girl called 911. From her hospital bed, she was able to give an accurate description to a Jeffco Sheriff’s Office sketch artist.
McDaniel was arrested two days after the attack. DNA found at the scene reportedly linked him to the attack.
“This girl is pretty impressive. She fought (the attacker) off. She fought with everything she had, and he finally gave up and left,” sheriff’s spokesman Mark Techmeyer said at the time of the incident. “She was brave and she was strong and determined not to be a victim. For a juvenile teenager, that’s impressive.”
Techmeyer said the girl was aware enough to not only provide the sketch artist with an accurate description, she also looked outside after the attack and was able to describe the assailant’s car. The sketch and the description of the car were critical to making an arrest, Techmeyer said.
At the time of the attack, McDaniel was out of Douglas County jail on bond in a separate case. He was found guilty in a Douglas County court of misdemeanor unwanted sexual contact on Jan. 15.
McDaniel faces a mandatory minimum sentence of 10 years to life in prison in the Jeffco case. He is scheduled to be sentenced on April 17.
